Boating Under the Influence

Often an arrest for Boating Under the Influence of alcohol and/or drugs will come at a time when it is totally unexpected. You may be out on a lake or at "The River" with friends having a few beers and the next thing you know you've been arrested for boating under the influence. Under California law, if you operate a vessel after having alcoholic drinks you may be arrested for boating under the influence. A boating under the influence conviction in California will appear as a DUI on your DMV driver record and you may lose your driver license.

With a blood alcohol concentration (BAC) that is 0.08% or more, it is illegal for drivers 21 years of age and older to:

  • Drive vehicles or
  • Operate any recreational vessel, aquaplane, water skis, or similar devices.

With a BAC that is 0.04% or more, it is illegal for drivers 21 years of age and older to:

  • Drive commercial vehicles or
  • Operate any recreational vessel, aquaplane, water skis, or similar devices.

With a BAC that is 0.01% or more, it is illegal for drivers under 21 years of age to:

  • Drive vehicles or
  • Operate any vessel, aquaplane, water skis, or similar devices. You are subject to fine, jail, and participation in an alcohol education or community service program.

A BAC below legal limits does not mean that it is safe to drive. Almost all drivers show the effects of alcohol at levels lower than the legal limit.

  • Significant fines, penalty assessments and victim restitution fund payments ($1000-2000!)

  • Vehicle impoundment or permanent vehicle forfeiture.
  • Mandatory AA or NA meetings Alcoholics Anonymous
  • Two Negligent Operator Points - DMV Hearings, Guidelines and Sanctions
  • DMV administrative action against your Driver License - An Administrative Per Se Hearing (A.P.S. Hearing) is needed to save your Driver License. The DMV must be contacted within ten days of arrest to request a hearing to stop your automatic driver license suspension! Otherwise DMV will impose an automatic driver's license: suspension, restriction or revocation. (Four month suspension for a 1st offense and a 1 yr. suspension for a 2d offense or Refusal or up to a three year revocation).
