Alcohol and Domestic Abuse
Alcohol is a common element in many domestic abuse cases. Alcohol consumption has a tendency to lessen one's inhibitions and turn a minor incident into a devastating act of violence. There is much debate on just how strong a role alcohol abuse plays in incidents of domestic violence, but it is clear that alcohol abusers have a greater chance of being the perpetrator in such incidents.
Whether alcohol is involved or not, many domestic violence charges arise out of misunderstanding on the part of the accuser or by police who arrive at the scene of a fight and assume that the male is the aggressor. It is important for anyone facing domestic abuse charges to contact an experienced Los Angeles criminal defense attorney to discuss their options.
California Domestic Abuse Laws and Penalties
There are many types of domestic violence charges in California. If you are facing any of these serious allegations, it is crucial that you have a skilled attorney on your side.
- Domestic Battery - California Penal Code 243 (e) (1) states: "When a battery is committed against a spouse, a person with whom the defendant is cohabiting, a person who is the parent of the defendant's child, former spouse, fiancé, or fiancée, or a person with whom the defendant currently has, or has previously had, a dating or engagement relationship." A conviction on these charges could lead to fines of up to $2,000 and up to one year in jail.
- Corporal Injury to a Spouse or Cohabitant: California Penal Code 273.5 states: "Any person who willfully inflicts upon a person who is his or her spouse, former spouse, cohabitant, former cohabitant, or the mother or father of his or her child, corporal injury resulting in a traumatic condition" may be charged with a felony. Penalties include imprisonment in a state prison for two, three or four years, or one year in a county jail or a fine of up to $6,000.
- Criminal Threats - California Penal Code 422 states: "Any person who willfully threatens to commit a crime which will result in death or great bodily injury to another person" may face up to a year in county jail.
Additional domestic abuse charges that may result from mistakes made while intoxicated include elder abuse (PC 368), Child Endangerment (PC 273a), and Child Abuse (PC 273d).
Defending Alcohol-Related Domestic Abuse Charges
Alcohol-related domestic abuse charges should be treated differently then a non-alcohol related allegation. Many accused offenders may have a serious problem with alcoholism and may require counseling and rehabilitation. If the offender has no prior criminal record or history of domestic violence, a criminal defense attorney may be able to have the charges reduced if the defendant attends an alcohol program or rehabilitation facility. Alcoholism is a serious illness that can negatively affect every aspect of a person's life.
