Consequences and Penalties

There are many forms of domestic violence and they all carry serious penalties. Anyone facing charges such as child abuse, domestic abuse, elder abuse, stalking or spousal abuse would be well-advised to contact a skilled and knowledgeable domestic violence defense attorney before talking to the police or the prosecutor, making statements or entering a plea.

County Jail and State Prison

Depending upon the severity of the allegations and the criminal history of the defendant, domestic abuse charges may result in incarceration. Even a first-time offender facing a misdemeanor charge may face up to a year in county jail for a domestic abuse charge if he or she does not have the representation of a skilled criminal defense lawyer. Typically, repeat offenders are slapped with the most severe punishment. Depending on the crime, if the defendant committed a similar crime within the last seven or 10 years, he or she may be charged as a repeat offender. Instead of a misdemeanor charge with a maximum of one year in county jail, a repeat offender may face a felony charge with two, three or four years in state prison.

Fines and Penalties

Most domestic abuse convictions result in a fine of up to $1,000 but there are many exceptions to this rule:

  • Child abuse under Penal Code 273(d) may result in a $6,000 fine.
  • Elder abuse under Penal Code 368 may result in a $6,000 fine or a $10,000 fine depending upon the specifics of the case.
  • Spousal abuse under Penal Code 273.5 often results in a fine up to $6,000.

Every case is different, but all convictions carry a heavy price.

Informal and Formal Probation

Domestic abuse convictions often result in probation. Formal probation requires the offender to register with the Adult Probation Department in his or her county. The defendant will be assigned a probation officer. The defendant will have to meet with the officer regularly to prove that he or she has learned from the experience and that they are no longer a threat. Informal probation does not require registration or supervision but it does mean that you agree to obey all laws during your probationary period. If you are arrested during your probation period, you may face steeper penalties then before.

California Three Strikes Law

A felony domestic abuse conviction may result in a strike that counts towards California's Three Strikes Law. Three strikes in California results in 25 years to life in state prison. This is just one of many reasons why it is important to aggressively fight any and all domestic violence charges in Los Angeles.
